Homeownnr LLC Limited Service Listing Agreement

This Limited Service Listing Agreement (“Agreement”) is entered into by Homeownnr LLC (“Broker”) and the undersigned (“Seller”). By signing this Agreement, the Seller grants Broker the exclusive right to list and market the property described below, subject to the terms outlined herein.

1. Authority to Sell Property

The Seller authorizes the Broker to list and market the property (“Property”) exclusively. The listing term begins upon payment of applicable fees and submission of listing information and ends six (6) months later. Extensions are available at the Seller’s written request prior to expiration, at no additional cost.

The Property will be marketed without discrimination, as required by law.

2. MLS Listing

The Broker will list the Property on the MLS, syndicating it to affiliated websites for maximum exposure. The Seller must:

  • Provide accurate listing information.
  • Update the Broker within 24 hours of changes (e.g., price, contract status).
  • Comply with MLS rules, including timely status updates.

Note: The Broker does not represent the Seller in negotiations or escrow and does not share commissions with the buyer’s broker unless separately negotiated.

3. Compensation

The Seller agrees to pay:

  • Flat Fee: $149 for Starter Listing, $349 for Essential or $499 upfront + $1,500 at closing for Seller Advantage.
  • Fees are non-refundable once the Property is listed on the MLS.

If the Seller offers compensation to a buyer’s broker, this arrangement must be negotiated separately.

4. Broker and Seller Responsibilities

Broker:

  • Market the Property as described on the website.
  • Provide access to MLS syndication.
  • Maintain honest and fair dealings with the Seller.

Seller:

  • Maintain legal authority to sell the Property.
  • Disclose all known material defects and comply with applicable laws.
  • Respond to inquiries and show the Property promptly.
  • Notify Broker of contract executions, cancellations, or closing details.

Indemnification: The Seller agrees to indemnify Broker against any claims, damages, or liabilities resulting from Seller-provided information or non-compliance.

5. Termination and Cancellation

  • The Seller may cancel this Agreement at any time unless the Property is under contract. For Seller Advantage, cancellations must occur at least 48 hours before a scheduled service (e.g., photography).
  • Listings without activity or responses for 15 consecutive days may be deemed abandoned and canceled without refund.

6. Broker Cancellation Rights

The Broker may cancel this Agreement if:

  • The Seller provides false information.
  • Legal issues arise that restrict the sale.
  • The Seller fails to respond to communication attempts.

7. Compliance and Disclosures

The Seller agrees to:

  1. Comply with all MLS and fair housing rules.
  2. Provide accurate documentation for closing, including sales contracts and settlement statements.
  3. Address FIRPTA obligations if applicable.

8. General Terms

  • Non-Liability: Broker is not liable for the condition or management of the Property.
  • Electronic Signatures: This Agreement may be executed electronically and is legally binding.

Important Note: Any compensation to a buyer’s broker, if applicable, is separate and must be negotiated directly between the Seller and the buyer’s broker.
